1. About These Terms

These Terms of Use ("Terms") govern the relationship between you and Sterren IT ("Sterren IT", "we", "us", or "our"), regarding your access to and use of our games, websites, and related services (the "Services").

The Services include all information, text, graphics, software, and other content made available through our games and websites, regardless of how you access them.

By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms.

We may update these Terms from time to time. Your continued use of the Services after the Terms have been updated constitutes your acceptance of the revised Terms.

Your use of the Services may also be subject to our Privacy Policy, which is incorporated into these Terms by reference.

2. Eligibility

Our Games are designed to be family-friendly. By using our Services, you confirm that:

• If you are under the age of 18, you have permission from a parent or legal guardian who has accepted these Terms on your behalf.
• If you are a parent or legal guardian accepting these Terms on behalf of a minor, you are fully responsible for their use of the Services.

We do not knowingly collect personal data from children under 13 without parental consent. See our Privacy Policy for more information.

3. Your Account

Some features of the Services may require you to register an account or link a third-party account (such as Apple or Google). By creating or linking an Account, you agree to:

• Keep your login credentials secure and confidential
• Not share your Account or credentials with anyone else
• Not create an Account using false information or on behalf of another person
• Not sell, rent, license, transfer, or otherwise make your Account available to any third party

You acknowledge that your Account, including all gameplay data, progress, achievements, and virtual items, is managed by Sterren IT on behalf of the Developer and remains the property of the Developer. You are granted a personal, non-transferable, revocable licence to use your Account solely for personal, non-commercial purposes.

Sterren IT may suspend, restrict, or terminate your Account if you breach these Terms, upload or share illegal content, or your behaviour poses a risk to the integrity of the Services.

Your Player ID

Each player has a unique identifier called a Player ID (also known as User ID). You can find your Player ID in the game settings. This ID helps us identify your account for support purposes.

4. Virtual Items and Purchases

Our Services may allow you to purchase, earn, or otherwise obtain virtual currency, items, or other digital features ("Virtual Items") for use within our Games.

Nature of Virtual Items

Virtual Items are digital content that exist solely within our Games and have no monetary or real-world value. They are not your personal property and cannot be exchanged for real money, goods, or services outside the Services.

All Virtual Items are licensed, not sold. You are granted a limited, non-exclusive, non-transferable, revocable licence to use them solely within the Services for personal, non-commercial use.

Purchases and Payment

Virtual Items are offered for purchase through third-party platforms such as the Apple App Store, Google Play Store, or other authorised providers ("Platform"). All purchases are subject to the Platform's own terms.

Refunds

We support refunds for purchases of Virtual Items where the Platform through which the purchase was made offers a refund. To request a refund, please contact the relevant Platform directly:

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

5. User Conduct

You agree that you will not engage in any of the following:

• Transmit content that is offensive, unlawful, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• Disclose another user's personal data without their consent
• Violate or infringe any third party's intellectual property or privacy rights
• Promote or engage in any illegal activity
• Improperly use Sterren IT's customer support channels
• Use unauthorised third-party software, bots, cheats, automation tools, mods, or exploits
• Sell, rent, license, or transfer any part of the Services in exchange for money or value

6. User Content

The Services may allow you to create and share content, including in-game chat messages, usernames, and similar content ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Sterren IT a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display it solely for the operation and improvement of the Services.

7. Intellectual Property

The game, including all content — such as the software, graphics, images, music, audio, text, animations, characters, and branding — is owned by or licensed to the Developer and protected by copyright, trademark, and other intellectual property laws. Sterren IT publishes and distributes the Services under licence from the Developer.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your personal, non-commercial entertainment purposes.

8. Termination

Sterren IT reserves the right to suspend, restrict, or terminate your access to the Services in cases of breach of these Terms, fraud, cheating, abusive behaviour, or where required by law.

You may terminate your use of the Services by contacting us at support@pdevs.net. Upon termination, your licence to use the Services will immediately end.

9. Disclaimers and Limitation of Liability

All content and services offered through the Services are provided "as is" and "as available," without warranties of any kind.

To the fullest extent permitted by law, Sterren IT expressly disclaims all warranties, whether express, implied, or statutory.

Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by applicable law.

Subject to the above, to the fullest extent permitted by law, our total aggregate liability to you for all claims shall not exceed the greater of: (a) the total amount you paid to us in the six (6) months prior to the event giving rise to the claim, or (b) €100.

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

10. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Netherlands.

The courts of the Netherlands shall have jurisdiction to settle any dispute arising out of or in connection with these Terms, except where mandatory consumer protection laws in your country of residence apply.

11. Miscellaneous

Our failure to exercise any right or provision of these Terms does not constitute a waiver of that right or provision.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sterren IT regarding your use of the Services.

12. Publisher Disclaimer

Sterren IT acts solely as the publisher of the Services. The game and its underlying content are owned and developed by a third-party developer ("Developer"). The Developer has chosen not to publicly disclose their identity at this time. By using the Services, you acknowledge and agree that:

• Sterren IT does not own, develop, or control the game or its content. All intellectual property rights in the game belong to the Developer.
• The Developer is solely responsible for the game's content, functionality, features, updates, bug fixes, and overall quality.
• Sterren IT makes no warranties, express or implied, regarding the game itself and disclaims all liability arising from the game's content, functionality, or performance to the fullest extent permitted by applicable law.
• Any claims, disputes, or issues relating to the game's content, functionality, or in-game experience shall be directed to the Developer, not to Sterren IT. Sterren IT will forward any such claims to the Developer on your behalf upon request.
• Sterren IT's role is limited to publishing and distributing the Services and does not extend to the development, maintenance, or support of the game.
